Terms & Conditions

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Member") and Vives's Gym, located at 104 Industrial Way, Austin, TX 78701. These Terms apply to all services provided by Vives's Gym, including but not limited to:

• fitness_center Physical gym facility access and equipment use
• groups Group fitness classes and personal training sessions
• language Website, mobile app, and digital services
• restaurant Nutrition consultations and supplement sales

To become a member of Vives's Gym, you must meet the following requirements:

Membership is personal and non-transferable. Sharing, lending, or selling your membership access is strictly prohibited.

All members are expected to conduct themselves with respect and professionalism. The following behaviors are strictly prohibited and may result in immediate membership termination:

Staff decisions regarding conduct violation are final. Banned members forfeit remaining membership fees with no refund.

To maintain a world-class training environment, all members must adhere to the following rules:

• check_circle Proper Attire: Closed-toe athletic shoes and appropriate workout clothing must be worn in all training areas at all times.
• check_circle Equipment Etiquette: Re-rack all weights after use. Wipe down equipment using provided sanitizing spray before and after each use.
• check_circle Time Limits: During peak hours, cardio equipment is limited to 30-minute sessions when others are waiting.
• check_circle Personal Belongings: Valuables must be secured in lockers. Vives's Gym is not responsible for lost or stolen items.
• check_circle Guests: Guests may only access the facility when accompanied by an active member and must sign a waiver. Maximum 2 guest visits per month per member.
• check_circle Mobile Phones: Keep volume low and avoid lengthy calls in the training area. Photography is restricted to designated zones.

• ▸ Membership fees are billed automatically on your subscription anniversary date each month.
• ▸ All payments are processed securely via our payment provider. We accept major credit/debit cards.
• ▸ A one-time enrollment fee of $25 applies to all new memberships.
• ▸ Failed payments will be retried twice within 7 days. Persistent failures may result in account suspension.
• ▸ Prices are subject to change with 30 days written notice to active members.

Cancel by contacting us at membership@vivesgym.com or visiting our front desk in person.

• check_circle Inform our staff immediately of any injuries, medical conditions, or medications that may affect your training.
• check_circle Stop exercising and notify staff if you experience pain, dizziness, shortness of breath, or discomfort.
• check_circle Emergency procedures, first aid kits, and AEDs are located at reception and all major training zones.
• check_circle Do not use broken or damaged equipment. Report any equipment issues to staff immediately.

To the fullest extent permitted by applicable law, Vives's Gym and its staff, officers, and agents shall not be liable for:

• — Any personal injury, illness, or death arising from the use of gym facilities or participation in fitness programs.
• — Loss, theft, or damage to personal property brought onto the premises.
• — Any indirect, incidental, or consequential damages arising from your use of our services.
• — Service interruptions, facility closures, or modifications to services due to circumstances beyond our control.

By signing your membership agreement, you execute a liability waiver acknowledging these risks and releasing Vives's Gym from related claims, except in cases of gross negligence or willful misconduct by our staff.

All content on the Vives's Gym website, mobile app, and promotional materials — including logos, images, training programs, videos, text, and design elements — is the exclusive intellectual property of Vives's Gym and is protected under applicable copyright, trademark, and intellectual property laws.

• ▸ You may not reproduce, distribute, or use our intellectual property without written consent.
• ▸ Our training methodologies and program materials are proprietary and confidential.
• ▸ Member-submitted reviews or testimonials may be used by Vives's Gym for promotional purposes.

Vives's Gym reserves the right to modify these Terms at any time. When changes are made, we will:

• email Notify active members via email at least 14 days before changes take effect.
• notifications Post a notice on our website and at the front desk.
• calendar_month Update the "Last Updated" date at the top of this page.

Continued use of Vives's Gym services after the effective date of changes constitutes acceptance of the revised Terms.
